These Terms & Conditions (“Terms”) form a legally binding agreement between Kommonify Ventures Private Limited (“Company”, “we”, “our”, “us”) and you (“User”, “you”, “your”), governing your access to and use of our web, mobile, and VR-based communication skillstraining platform (collectively, the “Platform”). 

By registering an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue the use of the Platform immediately.

 1. Eligibility

 1.1 Individual Users – To create and use an account, you must be at least 18 years old or have explicit consent from a parent or legal guardian. By using the Platform, you confirm that you meet this requirement.

1.2 Organizational Users – SMBs, enterprises, universities, training institutes, and other organizations must appoint an authorized representative to manage their accounts and contractual relationship with the Company.

1.3 Account Responsibility – You are fully responsible for maintaining the confidentiality of your login credentials and for all activities under your account, whether authorized by you or not. Any unauthorized use must be reported to us immediately.

2. Scope of Services

2.1 Service Offerings
Our Platform provides a combination of AI-powered and human-led tools to improve communication skills for high-stakes professional scenarios.

 Key features include:

• AI-Driven Assessments – Measuring parameters across verbal, non-verbal, and cognitivecommunication skills.
• Guided Pathways – Adaptive learning tracks designed for different industries, roles, andproficiency levels.
• High-Stakes Scenario Simulations – Customized practice sessions for interviews,presentations, pitches, and negotiations, with avatar and context customization.
• Cross-Platform Synchronization – Seamless switching between web, mobile, and VR devices, with progress tracking and unified analytics dashboards.
• Human-Led Coaching – Optional expert-led sessions for deeper feedback and skill building.

2.2 Service Models

• Free Trials – Limited access to features for trial purposes.
• Individual Plans – Monthly subscription billed in advance.
• Organizational Licenses – Bulk licensing for SMBs, enterprises, and universities under negotiated Master Service Agreements (MSAs).

3. Payment, Billing & Refund Policy

3.1 Payment Gateway

• All payments on the Platform are processed securely via Razorpay (www.razorpay.com).
• By making a payment, you agree to comply with Razorpay’s Terms of Service and Privacy Policy in addition to these Terms.
• Razorpay uses industry-standard encryption and compliance measures (including PCI DSS) to process transactions. We do not store your complete card or bank details on our servers.

3.2 Billing Terms

• Individuals – Subscription fees are charged monthly in advance and will auto-renew unless cancelled before the renewal date.
• Organizations – Payment schedules and invoicing terms are specified in the signed MSA or service agreement.

3.3 Refunds

• All subscription and licensing fees are non-refundable once the subscription term starts.
• In case of a billing error or duplicate charge, you must notify us within 7 working days for resolution. Refunds, if any, will be processed via Razorpay within 14 working days.

3.4 Taxes

• All fees are exclusive of applicable taxes, which will be charged as per the prevailing rates in your jurisdiction.

4. Intellectual Property

4.1 Ownership of Content

All AI models, algorithms, software code, UI/UX designs, assessment methodologies, scenarios, avatars, analytics dashboards, training materials, and any related content provided by the Platform are and shall remain the exclusive property of Kommonify Ventures Private Limited.

4.2 User License

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Platform strictly for your personal or organizational needs during the subscription or licensing period.

4.3 User Content

• You retain ownership of all content you upload (including audio, video, text, and transcripts)
• You grant us a perpetual, worldwide, royalty-free license to store, process, analyze, and use your content to deliver services, improve AI algorithms, and produce anonymized/aggregated analytics.

4.4 Restrictions

You must not:

•  Reverse-engineer, modify, copy, or redistribute any part of the Platform.
•  Use the Platform for creating competing products or services.

5. Data Collection & Privacy

5.1 Types of Data Collected

• Account Information – Name, email, phone, organization details, profile preferences.
• Performance Data – Audio/video recordings, transcripts, performance scores, feedback metrics.
• Technical Data – IP address, browser type, device identifiers, operating system, session analytics.
• Payment Data – Processed securely via Razorpay; we do not store full payment credentials.

5.2 Purpose of Data Processing

• Delivering personalized AI feedback and guided pathways.
• Maintaining Platform security and fraud prevention.
• Improving our AI models and platform features.

5.3 Data Security

• Data is encrypted both in transit and at rest.
• Access to data is restricted to authorized personnel only.
• We conduct regular security reviews and audits.

5.4 Privacy Compliance

•  We align with the Indian DPDP Act, GDPR, and global privacy best practices.
•  We are actively working towards SOC 2 and ISO 27001 certification for enterprise-grade compliance.

5.5 User Rights

• You may request a copy, correction, or deletion of your personal data by contacting us at info@kommonschool.com.
• You can opt out of marketing communications at any time.

6. Enterprise, SMB & University Terms

6.1 Enterprise/university clients are bound by the terms of their signed MSA, which takes precedence over these Terms in case of conflict.

6.2 Custom integrations with LMS, CRM, or HRMS systems are subject to separate agreements.

6.3 Unless restricted by contract, you grant us the right to use your name/logo in marketing materials, proposals, and case studies.

7. Acceptable Use Policy

• Share account credentials beyond the number of permitted users.
• Upload or share illegal, defamatory, or infringing content.
• Attempt to bypass security systems or gain unauthorized access to any part of the Platform.
• Use the Platform for competitive analysis, benchmarking, or reverse-engineering.

8. Disclaimers

8.1 The Platform and its services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

8.2 We make no guarantees regarding job placements, promotions, or specific business outcomes from the use of our Platform.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages.

9.2 Our total liability to you for any claim shall not exceed the total amount you paid us in the 12 months immediately preceding the claim.

10. Termination

10.1 By You – You may terminate your account at any time by contacting us.

10.2 By Us – We may suspend or terminate your account for violations of these Terms, non payment, or misuse of the Platform.

10.3 Termination does not relieve you of any payment obligations already incurred.

11. Governing Law & Dispute Resolution

11.1 These Terms are governed by the laws of India.

11.2 The courts of Gwalior, Madhya Pradesh, India shall have exclusive jurisdiction over any disputes.

11.3 Before initiating legal proceedings, both parties agree to attempt resolution via good-faith negotiation, followed by binding arbitration if required.

12. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on the Platform, and continued use after such changes constitutes acceptance of the revised Terms.
